Welcome to gobar (the “Service”, the “Site”, “we”, “us”, “our”). gobar provides an online platform that enables creators to receive tips/donations, sell digital/physical items, and offer memberships to supporters (collectively, “Creator Content”).

Accepting the Terms

These Terms of Use (“Terms”) govern your access to and use of the Site whether as a guest or a registered user. By accessing or using the Site, you agree to these Terms and our Privacy & Cookie Policy. If you do not agree, do not use the Service.

When you connect third-party services (e.g., login providers, payment providers, streaming platforms), you also agree to their respective terms and policies.

In a nutshell: Using gobar means you accept these Terms and any third-party terms you connect.

Who the Terms apply to

• Creators: operate a personal gobar page, receive donations/tips (“Donations”), sell products, offer memberships, post updates, communicate with supporters.
• Supporters: follow creators, send Donations, purchase items, subscribe to memberships.

Together, creators and supporters are “Users” or “you”. Specific terms for Creators and Supporters appear later.

gobar’s role

• We do not control Creator Content;
• We do not set commercial terms between Creators and Supporters;
• We are not a marketplace, agent, broker, money transmitter, financial institution, merchant of record, charity, or advisor;
• We do not process or hold payments on behalf of Users; payments occur directly between Users via third-party providers you choose;
• We are not the seller/reseller of Creator Content and are not responsible for pricing, delivery, refunds, chargebacks, or disputes.

Any interaction, agreement, or transaction occurs between Creator and Supporter. Contact the relevant Creator directly about their offerings or issues.

In a nutshell: We provide the platform; Creators and Supporters handle their own deals.

Changes to the Site and Terms

We may update the Site and these Terms to reflect features, legal or regulatory changes, or business needs. We’ll provide reasonable notice for material changes. Continued use after changes means you accept the updated Terms.

Disclaimer

The Site and all materials are provided “as is” without warranties of any kind, express or implied (including merchantability, fitness for a particular purpose, non-infringement). We do not endorse or guarantee any Creator or Creator Content, nor the accuracy or reliability of information on or linked from the Site. We exercise reasonable care, but we are not liable for errors, interruptions, or inaccuracies except as required by law.

In a nutshell: Use gobar at your own risk.

Reporting Content & Enforcement

We prohibit illegal content/activity and violations of these Terms and our Content Guidelines. If you believe content is illegal or violates these Terms, please report it to hello@gobar.fun with:

• the URL(s) and what specific item you refer to;
• why it’s illegal/violative;
• your contact details (optional, but may help us assess).

We prioritize reports concerning: terrorism, child sexual exploitation/abuse, threats of violence, severe harassment or hate, fraud/financial crime, instructions for illegal drugs/weapons, sex-trafficking/exploitation, doxxing/revenge porn, and similar serious harm.

We may use automated and human review to detect priority illegal content. If we take action (remove, disable, limit, suspend, or terminate), we’ll notify relevant Users and provide a way to contest, where reasonable.

In a nutshell: See something dangerous or illegal? Tell us - we investigate and act.

Purchases and Donations

gobar is not the seller of Creator Content and is not a party to Donations or sales. All terms (pricing, delivery, refunds, after-sales support) are set and fulfilled by the Creator. Donations are voluntary contributions with no obligation for the Creator to provide anything unless explicitly promised.

In a nutshell: Transactions are Creator ↔ Supporter. Creators handle everything about their sales.

Payments

Payments are completed directly between Users via third-party providers (card/pay services and/or crypto wallet providers). By using payments, you agree to those providers’ terms and policies. Some providers may display account identifiers or payer/payee details depending on account type, even if a message is marked “private”.

In a nutshell: We’re not a payment provider; your chosen providers handle payment details.

Linking, Scraping, Bots

Framing, scraping, bulk exporting, or automated interaction with the Site (bots, crawlers) without prior written consent is prohibited. We may revoke linking permissions at any time.

Account Requirements

• You must be 18+ to create an account or receive funds.
• Keep credentials confidential; you’re responsible for all activity under your account.
• We may suspend or disable accounts for violations or security reasons.
• If you suspect unauthorized use, notify us at hello@gobar.fun.

In a nutshell: Adults only; keep your login safe.

Privacy & Data

We process personal data in accordance with our Privacy & Cookie Policy. Creators and gobar are separate controllers of certain supporter data they receive. Creators are solely responsible for their own compliance (e.g., honoring deletion requests, using data lawfully, providing notices where required).

Security, Bugs & Viruses

We do not guarantee the Site will be secure or error-free. You are responsible for backing up your content and using your own security protections. Do not upload malware or attempt unauthorized access or denial-of-service attacks. We may report suspected criminal activity to authorities.

IP; Trademarks; License to Content

We (or our licensors) own all rights in the Site. You may not use our trademarks or trade dress without written permission.

Creators retain ownership of Creator Content but grant gobar a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, distribute, and create non-derivative promotional snippets of Creator Content solely to operate, promote, and improve the Service. You also grant us the right to disclose your identity to third parties asserting that your content violates their rights or the law.

We may remove content that, in our reasonable judgment, violates law or these Terms.

Materials on the Site

Materials may contain technical, typographical, or photographic errors. We may change materials at any time without notice and have no obligation to update them.

Termination & Suspension (general)

We may suspend or terminate access to all or part of the Service immediately if you materially breach these Terms, present a security or legal risk, or fail to pay applicable fees. You may close your account at any time through your settings (or by contacting hello@gobar.fun). Certain provisions survive termination (e.g., IP, disclaimers, indemnities, limitations of liability, arbitration).

CREATOR-SPECIFIC TERMS

Rules About Creator Content

You are solely responsible for all content you post (text, images, video, links, downloads, listings, price claims, fulfillment). You warrant you have rights to upload and grant the licenses above and will indemnify us for losses arising from your breach.

You become an independent data controller for supporter data you receive. Use it lawfully, only for interactions on gobar, provide a way to opt-out, and delete upon request where required.

Unacceptable Use (Creators)

• illegal content or activity; money laundering or sanctions violations;
• sexually explicit pornography, sexual services, or exploitation;
• content that is fraudulent, deceptive, or violates consumer protection;
• violent or extremely graphic content;
• hate speech or targeted harassment;
• sale of items/services to evade taxes;
• infringement of IP, trade secrets, or privacy rights;
• raffles/lotteries/games of chance with paid entry where prohibited;
• any activity payment providers or applicable law prohibit;
• anything we reasonably deem harmful to Users or the Service.

We may remove content or restrict accounts to protect Users and our business.

Creator Responsibilities

You set and honor your own commercial terms with Supporters, including pricing, description accuracy, delivery, refunds/returns, and customer support. You’re solely responsible for complying with applicable law (e.g., consumer rights, taxes, product safety, shipping/export controls, age-restricted content).

Taxes

You are solely responsible for assessing, collecting, reporting, and remitting any taxes (income, sales/use, VAT/GST, indirect taxes) arising from your activities. gobar does not provide tax advice and is not liable for your tax obligations.

Fees

Some features may require subscription or transaction fees. Fees (if any) will be disclosed in the Service at the time of purchase or in your account settings and may change upon notice. Where applicable, transaction fees may be deducted automatically by your chosen payment providers.

SUPPORTER-SPECIFIC TERMS

Creator Content & Decisions

We do not verify Creator Content and make no guarantees about its accuracy or lawfulness. Support thoughtfully and at your own discretion. For Donations, unless a Creator expressly promises a benefit, Donations are voluntary and non-refundable.

Unacceptable Use (Supporters)

• engage in abusive behavior, harassment, hate speech;
• attempt to financially harm Creators (e.g., bad-faith chargebacks);
• purchase with intent to evade taxes or launder funds;
• violate IP, privacy, or other rights;
• use bots, scraping, or exploit bugs;
• participate in prohibited gambling/lottery activities using the Service.

We may remove content or restrict accounts to protect Users and the Service.

COPYRIGHT / DMCA

If you believe content infringes your copyright, send a notice to hello@gobar.fun with:

1. identification of the work claimed infringed;
2. the URL of the material;
3. your contact info;
4. a statement you have a good-faith belief the use is not authorized;
5. a statement, under penalty of perjury, that the information is accurate and you are the owner/authorized to act;
6. your physical or electronic signature.

We may remove content and, where appropriate, terminate repeat infringers.

ELECTRONIC COMMUNICATIONS CONSENT

By using the Service, you consent to receive electronic communications from us (emails, in-product messages) related to your account, legal notices, and updates. You can opt out of marketing emails via unsubscribe links; transactional/legal notices will still be sent.

EXPORT CONTROL & SANCTIONS

You represent that you are not located in, under control of, or a national/resident of any country or list subject to U.S. embargo/sanctions and will not use the Service in violation of applicable export control or sanctions laws.

ARBITRATION; CLASS-ACTION WAIVER (U.S.)

PLEASE READ THIS SECTION CAREFULLY.

Except for claims eligible for small-claims court, any dispute arising out of or relating to these Terms or the Service shall be resolved by binding arbitration administered by JAMS (or another reputable administrator) in Los Angeles County, California, under its applicable rules. You and gobar waive the right to a jury trial and to participate in a class action, class arbitration, or representative proceeding. Each party may seek injunctive or equitable relief in a court of competent jurisdiction to prevent unauthorized use or misuse of IP or confidential information.

You may opt out of this arbitration agreement within 30 days of first accepting these Terms by emailing hello@gobar.fun with subject “Arbitration Opt-Out” and your account email.

LIMITATION OF LIABILITY

To the fullest extent permitted by law, gobar shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages; or for lost profits, revenues, goodwill, data, or business interruption; arising out of or related to your use or inability to use the Service, even if advised of the possibility. Our aggregate liability for all claims shall not exceed the greater of USD $100 or the amounts paid by you to gobar for the Service in the 3 months preceding the claim. Some jurisdictions do not allow certain limitations; in such cases, the limits apply to the maximum extent permitted.

INDEMNIFICATION

You agree to indemnify, defend, and hold harmless gobar and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Service; (b) your content or products; (c) your violation of these Terms or law; or (d) any dispute between you and another User.

GOVERNING LAW; VENUE

These Terms are governed by the laws of the State of California, without regard to conflict-of-laws rules. Subject to the arbitration clause, the exclusive venue for any permitted court proceeding shall be the state or federal courts located in Los Angeles County, California, and you consent to personal jurisdiction there.

FORCE MAJEURE

We will not be liable for any delay or failure due to causes beyond our reasonable control (including acts of God, labor disputes, internet/service provider failures, power outages, pandemics, governmental actions).

MISCELLANEOUS

• Entire Agreement. These Terms, plus policies referenced herein, are the entire agreement between you and us.
• Severability. If any provision is unenforceable, the rest remain in effect.
• No Waiver. Our failure to enforce a provision is not a waiver.
• Assignment. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale.
• Headings. For convenience only.
